Tamburino Talks Law: Legally Improper Mpls Park Board Decision Leads to Dangerous and Unclean Parks

Watch this Tamburino Talks Law on YOUTUBE by clicking this link https://youtu.be/waZEbqni5Po On Wednesday May 17th the Mpls Park board passed a resolution (2020-253) which allows anyone to pitch a tent, sleep in a tent and live in the tent in the Minneapolis park system. This resolution is procedurally and legally improper for several reasons.  First, it was not on the agenda given to the public days before the public hearing. It was added to the agenda during the hearing. In fact several commissioners, they didn't know it was coming up and didn't know language was in the resolution. It simply wasn't proper with no public debate and it not having gone through any type of committee. Second, many members of the park board seem to believe that Gov. Walz in his order (20-55) tells them that they can't do anything to homeless encampments. Well, that's legally incorrect. There are exceptions to project the public. Tamburino Talks Law: Statewide Mask Orders and COVID-19 Executive Orders

And, people are wondering could the governor of Minnesota issue such an order statewide. The quick answer to that is, "Yes, he could..." We've been under a peacetime emergency since March 13th. And, that gives the governor great power to issue executive orders. The governor could issue an executive order stating everyone in Minnesota when they go inside a place of public accommodation must wear a mask. In fact, California issued just an order. But here in Minnesota, Gov. Walz hasn't gone that far yet. He has issued many executive orders, but has never stated a requirement for masks only a strong recommendation. The Minneapolis Park Board passed a resolution to allow homeless encampments in all City of Minneapolis parks.  As this resolution attempts to solve problems, it's my legal take that it not only violates the law, but causes more problems to public health and public safety.
